Although Sun made Java open source, it did not include the right to use Java on mobile – that required a licence. Google knew that – it was found during discovery – but went ahead anyway. While Sun was being run by Jonathan Schwartz, Google had little to fear. The problems arose with Oracle’s takeover of Sun.

Google’s use of Java on mobile without a licence could be held by a jury to be wilful and therefore subject to triple damages. As a favourable result in this action is Oracle’s best near term chance of increasing its share price, a settlement looks unlikely.
